PropGhost aggregates data from official government registries. This data is provided for research and orientation purposes only. Always independently verify the current status of any property before taking financial, legal, or commercial action.

1. General

This disclaimer applies to all information, data, and content published on propghost.com and made available through the PropGhost platform (the "Service"), operated by Swisky (KvK: 42056446), Hengelo, Netherlands.

By using the Service, you acknowledge that you have read and understood this disclaimer.

2. Data Accuracy and Registry Lag

PropGhost sources its property data exclusively from official government registries, including but not limited to BAG (Basisregistraties Adressen en Gebouwen), Kadaster, KvK (Kamer van Koophandel), CadGIS, Leerstandsmelder.de, and HM Land Registry.

These registries are authoritative but not real-time. By their nature, registry updates can lag behind actual conditions by days, weeks, or months. As a result:

A property shown as vacant may have been reoccupied since the last registry update.
Ownership records may not reflect recent transfers, inheritances, or corporate restructurings.
Building status and usage type may have changed without yet being reflected in the registry.
Company information obtained via KvK may differ from a company's current legal or operational status.

PropGhost displays a reliability score per property to indicate data confidence, but this score does not guarantee accuracy. You must independently verify the current status of any property before acting on the information.

3. No Professional Advice

Nothing on the PropGhost platform constitutes financial, legal, investment, or valuation advice. The Service is an information and research tool only. PropGhost is not a licensed real estate agent, broker, valuer, or financial adviser.

Before making any investment, purchase, or legal decision based on data found through PropGhost, you should consult a qualified professional in the relevant field.

4. Estimated Property Values

Where PropGhost displays estimated property values, these are algorithmic estimates derived from WOZ data, surface area, property type, and local market comparables. They are indicative only and do not constitute:

A professional property valuation (taxatierapport) as defined under Dutch or EU law.
A basis for mortgage, financing, or insurance purposes.
A guarantee of achievable sale or rental price.

Actual market values may differ materially from estimates shown on the platform.

5. Intellectual Property

All software, source code, design, visual elements, and non-registry content on PropGhost are the intellectual property of Swisky, unless explicitly stated otherwise. Third-party registry data (BAG, Kadaster, etc.) is subject to the open data licences of the respective government bodies.

You may not reproduce, distribute, or commercially exploit PropGhost's proprietary content without prior written permission from Swisky.

6. Third-Party Links and Services

The Service may display satellite imagery provided by Mapbox and links to external government registries and other third-party sources. PropGhost has no control over the content, availability, or accuracy of these external sources and accepts no liability for them.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Swisky and PropGhost expressly disclaim all liability for:

Decisions made in reliance on data, estimates, or information provided through the Service.
Losses arising from inaccurate, incomplete, or outdated registry data.
Direct, indirect, incidental, consequential, or special damages of any kind connected to use of the Service.
Temporary unavailability or interruptions of the Service.

8. Contacting Property Owners

PropGhost may provide registered ownership information obtained from public sources (Kadaster, KvK). You are solely responsible for ensuring that any contact with property owners complies with applicable law, including privacy regulations (GDPR/AVG) and anti-harassment provisions. Unsolicited commercial approaches must comply with the Dutch Telecommunications Act (Telecommunicatiewet) and any other applicable rules.

9. Applicable Law

This disclaimer is governed by the laws of the Netherlands. Any disputes relating to this disclaimer shall be submitted to the competent court in the Netherlands.
