1. Acceptance of Terms

By accessing or using PropGhost ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.

2. Description of Service

PropGhost is a real estate intelligence platform that aggregates publicly available vacancy register data, land registry information, and ownership records to help investors and developers identify potentially vacant commercial properties. PropGhost is operated by Swisky, based in the Netherlands.

3. Data Accuracy Disclaimer

All property data displayed on PropGhost is sourced from official government registries (including BAG, Kadaster, CadGIS, Leerstandsmelder, and Land Registry). While we strive to keep data accurate and up to date:

• Registry data may lag behind actual property conditions by weeks or months.
• A property listed as vacant may have been reoccupied since the last registry update.
• Estimated property values are algorithmic estimates only and do not constitute professional valuations.
• You must independently verify the current status of any property before taking action.

PropGhost accepts no liability for decisions made based on data provided through the Service.

4. Permitted Use

You may use PropGhost for lawful real estate research and investment purposes. You may not:

• Scrape, copy, or redistribute PropGhost data in bulk.
• Use the Service to harass, contact, or approach property owners in an unlawful manner.
• Resell or sublicense access to the Service without written permission.
• Attempt to circumvent plan limitations or access controls.

5. Subscriptions & Billing

PropGhost offers paid subscription plans billed monthly. All plans include a 14-day free trial. You may cancel at any time; cancellation takes effect at the end of the current billing period. No refunds are issued for partial periods. Payments are processed by Stripe.

6. Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may delete your account at any time by contacting hello@propghost.com.

7. Intellectual Property

All software, design, and content on PropGhost (excluding third-party registry data) is the property of Swisky. You may not copy, modify, or distribute it without permission.

8. Limitation of Liability

To the maximum extent permitted by law, PropGhost and Swisky are not liable for any indirect, incidental, or consequential damages arising from use of the Service, including but not limited to losses resulting from reliance on property data.

9. Governing Law

These Terms are governed by the laws of the Netherlands. Any disputes shall be subject to the jurisdiction of the courts of the Netherlands.
